Making a birth injury claim – what you need to know

Making the decision as a family to pursue a birth injury claim following a serious incident that is believed to have been preventable often follows frustrated attempts to receive an acknowledgement and answers from the hospital responsible.

In some cases, it may be some time before it is realised that a baby is not meeting key milestones and may have physical and cognitive difficulties due to a serious injury sustained before, during or just after their birth.

Leading birth injuries solicitor Diane Rostron said: “When families start or grow their family, the very last thing that they expect to experience is medical errors which result in significant injuries to their child or in some cases, the death of their baby.

“It is often unclear to families who find themselves in these sad circumstances whether an error was made by medical staff, but they strongly suspect that something must have gone wrong. The first step is for families to contact the hospital where the alleged incident took place to raise concerns.

“What should subsequently happen is an investigation by the hospital into what happened. This should identify whether avoidable mistakes were made and if so, an acknowledgement, and an apology, should be provided to the family.

“In our extensive experience however, families are often left in the dark. What they do know is that they have suffered a loss or that their child has significant, and permanent, unexpected injuries. The answers they seek are often left unanswered as they struggle to deal with this difficult reality.

“Making the decision to take the legal route is not one that is taken lightly by the families that we represent but they are often left with no other choice in order to discover what really happened and to access the compensation that is essential for meeting their child’s complex needs.

“Our team of birth injury experts understand the traumatic impact following medical negligence on the entire family. We support our clients every step of the way to minimise what will be an upsetting and stressful process to ensure that they receive the justice that they deserve.”

Diane Rostron and her team of medical and legal experts have a strong track record of securing £multi-million birth injury settlements. The birth injury specialists won a £17.9 million settlement for a family in Wales in 2019.
